The human remains located in the Clay County landfill on Wednesday, April 22, 2020, have been positively identified by the Ramsey County Medical Examiner’s Office as Dystynee Avery.

An additional person has been taken into custody on Accessory to Murder Charges. Brandon Erbstoesser, age 33, of West Fargo, was taken into custody without incident today in West Fargo by members of the US Marshals Service High Plains Fugitive Task Force and the West Fargo Police Department. Ebstoesser is currently being held in the Cass County, ND Jail pending extradition.
