Smoking or Vaping:
One or Two-family Homes: May be permitted or not permitted per smoking/vaping policy in lease agreement. Cannabis cannot be used in a location where the smoke, aerosol or vapor of a cannabis product could be inhaled by a minor.
Multi-family Buildings (3 or more units): Not permitted by State Statute in units or on balconies/patios. This is enforced by the MN Office of Cannabis Management and complaints can be filed here: Office of Cannabis Management Complaint
Exception: Renters who are enrolled in the Medical Cannabis Registry are permitted to smoke or vape in all rental housing unless the housing is affiliated with the U.S. Department of Housing and Urban Development (HUD). Due to the federal prohibition of cannabis, HUD does not have the discretion to admit or retain users of cannabis, including medical cannabis, to the public housing program.
Growing: Consult your legal counsel on either permitting or prohibiting growing on/in your rental property.
Production of Concentrates: Processes that create cannabis concentrate are not permitted within any residential rental properties.
